Terms and Conditions
The RAHONA company offers services related to the discovery of selected aromas and grape varieties. The RAHONA company operates the Website from which it offers to its Customers, on a principal basis, 3ml bottles of aromas accompanied by an access to corresponding ebooks. Access to and use of these Services are governed by the present General Conditions, of which only the French version is authentic. Visitors, Subscribers and Clients have the option to save and print them. RAHONA commits itself to do its utmost to ensure that delivery times are respected.
2, Purpose of the General Conditions
The purpose of the present General Terms and Conditions is to define the terms and conditions according to which RAHONA makes its Website available to Visitors, Registrants and Customers and offers its Products and Services detailed below.
3. Acceptance of these General Conditions
The present General Conditions apply to all Visitors, Subscribers and/or Customers of the Website. Access to and use of the Site implies the Visitor's, Subscriber's and/or Customer's acceptance of these Terms and Conditions. Placing an Order on the Site implies full and complete acceptance of these Terms and Conditions. If you do not agree with the clauses set out below, you are advised not to use the Site and/or not to place an Order. The applicable Terms and Conditions are those in effect on the day you visit the Site or place an Order. The present General Conditions may be modified by RAHONA. In this case, RAHONA will inform the Customers and the new General Terms and Conditions will only be applicable to Orders placed after the modification. If you do not agree with the modified General Terms and Conditions, you are advised to refrain from using the services of the Site. Otherwise, the modifications made to the Terms and Conditions will be deemed accepted.
4. Sales and Services to individuals
RAHONA reserves its Products and Services exclusively for consumers and/or non-professionals within the meaning of the Consumer Code. Every customer commits himself to act in this capacity. RAHONA reserves the right to refuse or cancel any Order and/or Subscription from a Customer who proves to be a professional reseller.
5. Shipping and delivery
The Products are shipped to the Customer through the carrier selected by RAHONA. RAHONA will do its best to ensure that the deliveries are received by the Customers within fifteen (15) working days, this period not being applicable to possible deliveries outside Metropolitan France. The Products are delivered to the address indicated by the Customer or to a relay point chosen by the Customer, at the discretion of Rahona. If all or part of the addresses or information necessary for the delivery provided by the Client are incorrect, obliging the carrier selected by RAHONA to return the Products, it will be the Client's responsibility to bear the costs and consequences. The Customer may at any time, up to 72 hours before the shipment of the Products, modify his delivery address or his relay point by contacting Parler Vin customer service. The modifications will be applied as from the first expedition following the request of the Customer.
6. Access and use of the Site
6.1. RAHONA strives to keep the Site accessible without being bound by any obligation to do so. Access to the Website may be interrupted for maintenance, updating or any other technical reason. 6.2. Before placing any Order, the Visitor must fill in the information requested, in particular his Personal Data. As soon as his Personal Account is created, the Subscriber shall receive an e-mail confirming the latter. Only one Personal Account per person (same name, same first name, same e-mail address) is allowed. 6.3. The Subscriber guarantees the accuracy, sincerity and reliability of the information provided, particularly the Personal Data. In particular, the Subscriber provides a single valid and functional e-mail address, which will be a means of communication between him/her and the RAHONA company, nor the consequences of disclosure. 6.4- User Comments or Other Submissions If, at our request, you send certain specific submissions (e.g., contest entries) or if, without our request, you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, "Comments"), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium the Comments you send to us. 7 Gift Card
7.1. Purchase of a Gift Card Any Customer may purchase a Gift Card on his/her own behalf or on behalf of a Beneficiary. In this case, a unique activation code (e-Code) indicated on the Gift card and communicated by email (or if necessary by post) to the address indicated at the time of purchase by the Customer, allows the Beneficiary, or the Customer if necessary, to subscribe to the purchase of a prepaid flavour box. The Customer is responsible for transmitting the Gift Card to the Beneficiary of his/her choice or for communicating his/her exact email address, it being understood that the Beneficiary must be a natural person of legal age in his/her state or province of residence. Under no circumstances can RAHONA be held responsible for this. The purchase of a Gift Card for one's own account is reserved for customers of legal age. The price indicated in the Order confirmation is the final price, including VAT at the current rate, when the sale is subject to this tax. 7,2. Duration and validity of the Gift Cards The Gift Card must be used within six (6) months following the date of its dispatch by email or post. After these six (6) months, the e-Code will lose its validity and the Gift card will not be refundable. It is understood that the date of subscription of the Subscription corresponds to the date of activation by entering and validating the e-Code on the Site. 7.3. Use of the Gift cards The Gift cards are not nominative. They contain a unique code (e-Code) allowing their use by the Beneficiary, or the Customer if necessary. The Client and the Beneficiary certify having read the present General Conditions, accessible via the URL address indicated on the dematerialized Gift card: The purchase and the use of a Gift card imply the acceptance without reserve of the present General Conditions. The Beneficiary shall send to Rahona his full contact details and this code for validation and then benefit from the Subscription selected by the Customer. In case of use of a Gift Card on the Website, all of the present Terms and Conditions shall apply in their entirety to the Beneficiary. Gift cards cannot be resold or exchanged for cash.
The prices indicated are in Euro. If a price is shown in another currency, this amount is only indicative. The prices of the various expenses are those indicated at the time of the Order (shipping costs, packing costs, ...). Deliveries outside France for any Subscription subscribed or any Order placed on the Site may be subject to possible taxes and customs duties that are imposed when the package reaches its destination. These possible customs duties and taxes related to the delivery of the Products are the sole responsibility of the Customer. RAHONA is not obliged to check and inform the Customers of the applicable customs duties and taxes. In order to know them, RAHONA advises the customers to get information from the competent authorities of their country. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice. We will not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
9. Payment methods and security
In order to optimize the security of transactions, all payments made by credit card on the RAHONA website are made via secure online payment systems, in particular "Stripe".
10.1. Product Conformity The Customer is responsible for carefully checking the condition and conformity of the Products delivered to him/her. The Customer may then either accept the Order if it appears to be in conformity, or refuse the Order if it is clearly not in conformity (broken bottles) by following the procedure set forth in Article 11.2 hereof. 10.2. Refusal of the Order In case of refusal of an Order by the Customer at the time of delivery, it is the Customer's responsibility to inform RAHONA by post or by e-mail at the following addresses RAHONA, Customer Service, 19 rue Louis Plantier 69500 BRON - FRANCE email@example.com In any case, the Customer must take care to clearly indicate in the letter or e-mail, all the information requested as well as the precise reasons justifying the return or refusal of the Order, except in the case of a simple retraction occurring within fourteen (14) days after the order.
11. Right of withdrawal
11.1. In accordance with the provisions of Articles L.221-18 et seq. of the French Consumer Code, the Customer or the Beneficiary has a right of withdrawal which allows him/her to cancel the Order without giving any reason, within a period of (14) days from the receipt of the first Product(s) ordered. 11.2. Only the direct costs of returning the goods in good condition (unopened and undamaged bottle(s), including the label) will be charged to the Customer or the Beneficiary. 11.3 To exercise his right of withdrawal, the Customer or the Beneficiary must notify his decision on plain paper or via our contact form or in the e-mail attached to the confirmation of his Order of the present General Conditions, and send it by simple letter to : RAHONA - Customer Service - 19, rue Louis Plantier, 69500 BRON, or by e-mail to firstname.lastname@example.org.
12. Personal Data
The Visitor and the Customer are informed that the Personal Data requested and/or collected by RAHONA on the Site and concerning him are treated in accordance with the Privacy Charter and the RGPD rules.
13. Intellectual Property
13.1 No use of the brands and/or logo "RAHONA" or "Parlervin" can be made without the prior written consent of the company RAHONA. 13.2. All content, in whole or in part, that appears or is available on the Site (including but not limited to: data, information, texts, illustrations, logos, trademarks, computer graphics, photographs, videos, software and computer programs, databases, etc.), and more generally all or part of the Site itself, are protected by copyright and other intellectual property rights for France and the entire world. 13.3. The present General Terms and Conditions do not entail the transfer of any of these intellectual property rights to the benefit of Customers and/or Visitors and/or Registrants. Consequently, the latter are formally prohibited from reproducing and/or using all or part of the contents that appear or are available on the Site and all or part of the Site itself. Clients, Subscribers and Visitors are also prohibited from copying, modifying, altering, translating, reproducing, distributing, selling, publishing, exploiting or disseminating the said elements in any way and in any form or medium whatsoever. 13.4. Failure to comply with any of the provisions of this article exposes its author (Visitor, Subscriber, Customer and/or any third party) to prosecution and incurs the criminal and civil liability of its author, particularly on the basis of trademark and copyright infringement.
14. Liability and force majeure
However, RAHONA shall not be held liable: In case of non-compliance by the Customer with the terms of these GTC; For any indirect and/or immaterial damage, including but not limited to bodily injury suffered as a result of the Order, the use of the Products or the loss of reputation that may result from the use of all or part of the Products. RAHONA shall not be held responsible for any malfunction of any kind relating to the Visitor's / Subscriber's / Customer's computer equipment or Internet access connection when accessing the Site. In this context, the Visitor / Subscriber / Customer guarantees the company RAHONA against any action, recourse or claim in relation to all of the aforementioned elements and, in particular but without limitation, those that would call into question the use of the Subscriptions offered on the Site, as well as the use that could be made of the Products. RAHONA cannot be held responsible for the non-performance of the contract in case of an event of force majeure, as defined by article 1240 of the Civil Code. We do not guarantee that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that, from time to time, we may withdraw the service for indefinite periods or cancel the service at any time without notice. In no event shall Rahona Company, our directors, officers, employees, affiliates be liable for any injury, loss, claim, or direct, indirect, incidental, punitive, special or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, lost data, replacement costs, or any other similar damages, whether based on contract, tort (including negligence), strict liability or otherwise, arising out of your use of the service or any product obtained through the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of your use of the service or any content (or product) posted, transmitted or made available through the service, even if you have been advised of their possibility. Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions our liability shall be limited to the maximum extent permitted by law.
15. Applicable Law
Dispute Resolution 15.1. These Terms and Conditions are governed by French law. 15.2 In the event of a dispute arising in connection with these General Terms and Conditions, their interpretation and consequences or with the acts supplementing or modifying them, the parties shall always endeavor to find an amicable solution before bringing the matter before the courts.
